  • faulty batch of Thermomax vacuum tubes

    I live in the UK, and installed 30 Thermomax vacuum tubes for hot water heat just before Thermomax was bought by Kingspan. They were professionally installed and tested. However we recently had some roof work done and discovered that ALL of them had lost their vacuum (within four years of installation). The local installer and supplier believe they were part of a faulty batch, and tried to get Kingspan to replace them. However, Kingspan is refusing to honor the 5-year warranty because they were purchased before Kingspan bought Thermomax. This seems very unfair - it seems to me that if you buy a company you have to accept the liabilities as well as the assets. Has anyone else had this experience, and do you have any advice? Thanks.

    Particularly if the acquisition was part of a bankruptcy proceeding, the acquirer may get all the physical or intangible assets and none of the obligations (after the full or partial payoff of bondholders, secured debt and shareholders, that is.)
    Or the original company may have been required to set aside some money in an insurance program or trust account before the sale. In that latter case, you may in fact have some recourse, just not through Kingspan.

      Did you get this sorted out we have Thermomax HP200 tubes instock which are not made any more.
